The situation

Every procedure has a statutory deadline.

Dutch administrative law sets a fixed term for every immigration decision. When the IND, an embassy or a municipality passes that term, the General Administrative Law Act (Awb 4:13) gives you a procedural right to act.

  • Asylum, 6 months (Vw 42 / EU Directive 2013/32).
  • Family reunification, 3 months national, 9 months EU ceiling (Directive 2003/86).
  • Highly-skilled migrant, 3 months (Vw 25).
  • Naturalisation, 12 months (RWN 9(4)).

What happens after the file opens.

  • Read your application and the authority correspondence.
  • Calculate the statutory deadline. Awb 4:13 or the procedure-specific term.
  • Draft the Notice of Default. Post it by registered mail the day the deadline passes.
  • Track replies and any extension letter under Awb 4:14.
  • Escalate: Ombudsman complaint, court appeal under Awb 6:12, or UN Special Rapporteur if applicable.

What the Notice triggers

A clock the authority cannot ignore.

Once the Notice of Default is received, the authority has 14 days to decide. Miss that, and a daily penalty (dwangsom) starts running under Awb 4:17, paid by the authority, to you.

  • Days 1–14: €23 per day.
  • Days 15–28: €35 per day.
  • Days 29–42: €45 per day.
  • Capped at €1,442, but the real point is it forces a decision.
