Terms of Service

1. Who we are

MigrationProvision B.V. (in registration) is a Dutch private limited company with offices at Bezuidenhoutseweg 30, 2594 AV The Hague, Netherlands. We provide an online administrative-assistance service by which natural persons may prepare and file procedural documents in their own name in respect of Dutch and EU administrative-immigration matters.

2. What this service is — and is not

The service is: a software platform that (i) assesses whether your application has passed its statutory decision-term, (ii) generates Notices of Default, Ombudsman complaints, Letters of Concern and UN Special Rapporteur submissions, and (iii) optionally dispatches those documents by registered mail on your behalf.

The service is not: the practice of law. We are not registered with the Nederlandse Orde van Advocaten. We do not provide bespoke legal advice. We do not represent clients before any court, tribunal or administrative authority other than by way of the procedural documents you authorise. Where litigation, substantive legal advice or in-court representation is required we refer to admitted lawyers.

4. Fees

The Assessment & Notice fee is €8.75, charged at submission of the assessment. The Escalation & Filing fee is €12.40, charged when step 2 of the case is activated (after authority response or 14-day silence). Optional registered-mail handling is +€4.95 per letter. Sworn translations are quoted separately.

If the assessment determines that your case is premature or requires lawyer representation, the €8.75 is automatically refunded within five working days. Once the Notice has been generated, the fee is not refundable.

5. No outcome guarantee

The mechanisms we activate are statutory rights. We can guarantee that the documents we generate are article-cited, addressed correctly and dispatched as instructed. We cannot guarantee that the authority will decide in your favour or within any particular timeframe. Outcomes depend on the authority, the merits of your underlying application, and circumstances beyond our control.

6. Liability

To the maximum extent permitted under Dutch law, our liability for any loss arising from the use of the service is limited to the total fees paid by you for the case in question. We are not liable for indirect, consequential or punitive damages, including but not limited to lost residence rights, lost employment, lost income or moral damages.

Nothing in these Terms limits our liability for intent, gross negligence, or any liability that cannot be limited under Dutch consumer law.

7. Communication

The official channel for case communication is the in-portal messaging. Email is acceptable for general matters. Telephone is not currently offered. We reply within two Dutch working days; usually faster.

8. Termination

You may close your account at any time from Account → Privacy. We may suspend or terminate accounts for abuse, fraud, attempted misuse of the platform, or violation of these Terms. Pending cases will be transferred to you in a portable format before termination where possible.

9. Changes

We may amend these Terms. Material changes will be notified at least 14 days in advance by email and in the portal. Continued use after the effective date constitutes acceptance.

10. Governing law & disputes

These Terms are governed by Dutch law. Disputes will first be brought to contact@migrationprovision.com and, where unresolved, before the competent court at Den Haag, without prejudice to any mandatory consumer-protection rights to choose a different forum.
