Some circumstances can move the case to the front of the queue.

There is no single "priority button". Each authority has its own urgency framework: the IND has the "spoedprocedure" and "prioriteit toekennen" for specific categories, the district court has the voorlopige voorziening for irreparable harm, and the ombudsman can flag for accelerated investigation. What the categories share: serious, demonstrable, and time-sensitive circumstances.

What counts as urgent in practice

Authorities and courts apply similar criteria. The shorthand: a serious harm that will become irreparable if the decision waits its normal turn. Examples from the published case-law and IND working instructions:

Urgency is not subjective. It must be evidenced. The authority will ask for medical certificates, school enrolment letters, doctor's statements, or country-information reports.

How to ask the IND

    Write a separate priority-request letter
    It is its own document, not a paragraph in another letter. The IND processes priority requests through a dedicated team.

    Cite the category
    Open with: "Ik verzoek prioritaire behandeling van de aanvraag op grond van [category]." The IND's internal categories include medische urgentie, gezinsleven minderjarig kind, openbare orde, document termijn.

    Attach the evidence
    Medical certificates, school letters, custody documents, country reports. Without evidence the request is dismissed in the same letter as the refusal of priority.

    Send by registered mail
    PostNL Aangetekend or via Mijn IND with a follow-up tracking the case-number. Keep the proof of receipt.

    Follow up after two weeks
    If no priority-decision has arrived, write again and copy the ombudsman. Silence on a priority request is itself a behaviour the ombudsman investigates.

How to ask the court for a voorlopige voorziening

If you have an open objection (bezwaar) or court appeal (beroep) and a decision is needed quickly to prevent irreparable harm, the voorzieningenrechter (provisional-relief judge) can grant interim relief under Awb 8:81. The application is filed alongside the main appeal.

The priority request goes out separately from and faster than the Notice of Default, often within 24 hours. The ombudsman copy follows automatically.

Frequently asked questions.

Can I ask the IND to speed up just because I have been waiting a long time?
Long waiting alone is not a priority category. The remedy for normal delay is the Notice of Default plus daily penalty under Awb 4:17. Priority requires a separate, serious circumstance.
How long does an IND priority request take?
The IND aims to respond within two to four weeks. If granted, a decision typically follows within four to eight weeks. If refused, the refusal must give reasons.
Does priority handling cost extra?
Not at the IND. The application fees are the same. The court fee for a voorlopige voorziening is €51. MP's escalation step is €12.40 regardless of urgency.
What evidence is enough for medical urgency?
A specialist's written statement on letterhead describing the condition, treatment, and why residence status matters. A GP's note is usually not sufficient on its own.
My partner is abroad and our child is here. Is that urgent?
Parent-child separation involving a minor is one of the recognised categories. The strongest version is a single parent here with the other abroad and no alternative care. Send custody papers and the child's school enrolment.
Can the ombudsman speed up my case?
The ombudsman can flag a case for spoedonderzoek (urgent investigation). It cannot order priority but the public attention often produces a decision quickly.
What if my passport expires soon?
A passport-expiry within two months is sometimes accepted as urgent. The IND prefers you to renew the passport first and then apply. Bring proof that renewal is not possible (embassy refusal, country instability).
Does asking for priority hurt my chances if refused?
No. A refusal of priority is procedural, not substantive. It does not affect the merits of the original application.
Can MigrationProvision file a priority request for me?

Is there a list of categories the IND recognises?
